One of the biggest motivations for filing bankruptcies is simply because the debtor wants the calls to stop. One of the first questions I get is “will the creditors stop calling me?”. Once the individual files the bankruptcy petition everything changes. The creditors now have to go through the attorney. If you are a secured creditor then there will be steps a creditor has to take in order to lift the stay. If the creditor is unsecure the they have to stop calling and wait for process to play out. The unsecured will more then likely will have to do without because the debt will more then likely be discharged. If the debt is large enough and if there is grounds the creditor may hire their own attorney and fight the discharge. If you have a co-signor on a debt and they are not filing for bankruptcy the creditors will still be able to call them .
In a chapter 7 bankruptcy the unsecured creditors will be in danger of having the money owed to them charged off. They will be able to show up at the creditors meeting but their arguments will be limited. This is why many of them are quick to negotiate the debt owed to them if given the chance.
In a chapter 13 bankruptcy there will be a repayment plan. This gives the creditor the best opportunity to recover the debt owed to them even if it’s at a reduce rate.
