In doing your research you will hear the same thing over and over. Consider your other options before filing for bankruptcy. So the question is what are these options?
The first thing you want to do if you want to get out of your situation without filing for bankruptcy is to create a plan to attack your personal financial problem. It will be difficult but possible.
For situations with large credit card. Everyone one the balances can be negotiated and in some instances the payments can be reduced. If you can not afford to pay them at all what you can do it let them sue you. If a judgment is entered against you the you will more then likely be given a chance for a payment plan. The problem with this option is that they can begin collection proceedings. This means that they could try to garnish your wages and or attempt to take any asset you may have.
If the reason you are considering bankruptcy is for hospital bills the you could also attempt to enter into a payment plan. Again the danger with this is that you could end up getting a judgment against you and be subject to all the collection activity including the phone calls.
If bankruptcy is being considered to save your home from foreclosure my advise is to try to other options. Attempt a modification early. There are many lawyers that handle these matters. If this doesn’t work and you can’t afford the payment you can try and short sell the house. In many instances you can even get the mortgage company to pay moving expenses.
