In making your decision you will go through a case evaluation. This process like any other process in life is one that you should through very carefully. Our firm begins our evaluation by setting up an appointment to see the client. As a client you should have a list of what you owe and who you owe it to. You should also have a list of all your assets. You should bring both lists to the interview. You then have to look at the reason why you are considering bankruptcy. If it’s because you owe an enormous amount of money and you can not pay it back and it’s not letting you go on with your life then I would say that is a good reason. You must look to see how much you owe and who you owe it to. Some debts are not dischargeable. Some debts could be taken care of without filing bankruptcy. Bankruptcy should be your last option.
It is extremely important to understand that when you file for bankruptcy you are probabley not keeping your non-exempt assets. The only thing you will keep are assets that fall under exempt. The items that are exempt are listed and it is not a long list. The other items that are non-exempt are sold to pay for some of the debts. In many situations you are given the opportunity to buy them back but it’s a catch 22 because if you are filing for bankruptcy chances are you do not have the money to buy anything back. If the assets are purposely not listed you could be exposing yourself to criminal problems because you are now keeping the information from the court and it would be considered lying on the petition.
Many times when people run into financial problems they begin getting calls from creditors. The situation many times become unbearable and the person begins to consider bankruptcy just to stop the calls. This is not a good reason. If the debt is small enough it can be resolved by negotiating , entering a payment plan or other methods. Ultimately it’s up to you if you could take it or not. The filing of a bankruptcy will affect your future for a while. Lastly if you decide you do want to go through with a bankruptcy my advice is for you to hire an attorney. I have sat at 341 meetings and seeing individuals that paid someone to do the paperwork but were there alone and could not answer any questions. This scared them and caused confusion, Whatever money they saved was not worth it.
